VIDEO: Minority Threatens Legal Challenge Against Attorney General Over Duffuor Case Withdrawal

The Minority in Parliament has served notice of a possible legal challenge against Attorney General Dr. Dominic Ayine following his decision to discontinue criminal proceedings against former Finance Minister Dr. Kwabena Duffuor in relation to the collapse of UniBank Ghana.

The Ranking Member on the Constitutional, Legal and Parliamentary Affairs Committee, Mr. Kwame Anyimadu-Antwi, who addressed the press on behalf of the Minority, described the Attorney General’s move to enter a nolle prosequi—a formal notice to discontinue the prosecution—as troubling and potentially unconstitutional.

According to Mr. Anyimadu-Antwi, the decision is laced with conflict of interest concerns, noting that Dr. Ayine had previously served as legal counsel for Dr. Duffuor prior to assuming office as Attorney General. “This act raises serious questions about impartiality and undermines public confidence in the administration of justice,” he stated.

He further indicated that the Minority is prepared to seek judicial review of the Attorney General’s action in court, should the government fail to provide compelling justification for the discontinuation of the case.

Calling for broader public engagement, the Ranking Member urged lawyers, judges, civil society organizations, opinion leaders, and members of his committee to speak out against what he described as a setback for justice, transparency, and accountability in Ghana’s democratic process.

“The integrity of our justice system must never be sacrificed on the altar of political loyalty or personal connections,” he asserted.

The Attorney General is yet to officially respond to the Minority’s concerns.
